Privacy Policy
This Privacy Policy covers Visa Worldwide Pte. Limited’s ("Visa") treatment of personally identifiable information (" Personal Information") and other data that Visa gathers when Users access the Visa Explore App (the "App") and its related services and functionalities (collectively the "Services"). For the purposes of this Privacy Policy:
- "access" means download, use, browse or access
- "User" means any person who accesses the App
- "Registration Information" means the Compulsory Information and Personal Information provided by a User for the purpose of registration under the Visa Travel Happy Site (“Site”), if applicable, all as defined in the Terms of Use of the Site found at www.visatravelhappy.com
- "Social Network Account" means any social network account (such as but not limited to Facebook or Twitter account)
1. COLLECTION AND USAGE OF PERSONAL INFORMATION
1.1 Visa may receive and store any Personal Information that a User enters while accessing the App or using the Services, or which a User provides to Visa in any other way. Personal Information will or may include:
- Registration Information
- User name, profile of a User and User’s friend list on Social Network Accounts which the User links to his/her registration under the App
- Other personal information regarding a User’s use of the Services, and browser information
1.2 Personal Information provided by Users will be used by Visa for such purposes:
- allowing User to customize and set up a user profile that can be used to interact with other users through the App,
- improving the content of the App,
- customizing the advertising and content on the App,
- communicating with User about specials and new features of the App,
- operational and logistical notifications, and
- communicating with User about Visa-related offers (through App functionalities such as banners, alerts, notifications and others).
1.3 Visa may also draw upon this Personal Information in order to
- adapt the Services to user needs,
- research the effectiveness and benefits of the App and Services, and
- develop new tools on the App.
1.4 Visa employs, or may employ, other companies and people (“Visa Vendors”) to perform the above tasks on Visa’s behalf and Visa may need to share a Users’ Personal Information with them in order to do so. Visa however will not give Visa Vendors the right to use or keep any User’s Personal Information beyond what is necessary to assist Visa for these purposes, and Visa will require undertakings from Visa Vendors to provide a comparable level of protection for Users’ Personal Information, unless a longer period is required or permitted by law.
1.5 When a User accesses the App or uses the Services, Visa automatically receives and records information on Visa’s server logs from User’s browser or mobile app, including User location, IP address, cookie information, and the page requested by User. Visa also uses session data, collected through cookies (as explained in Clause 3 below) and pixel tags, to better understand how the App is navigated, how many visitors arrive at specific pages, the length and frequency of stays at the App, the variety of searches of the App’s database, the types of mobile phones used by visitors to the App and the internet protocol addresses from which visitors connect to the App. Visa treats all data obtained from the foregoing activities listed in this Clause 1.5 as non-Personal Information, except where Visa is required to do otherwise under applicable law. Visa may provide aggregate information to Visa’s partners (banks or merchants) about how Users collectively, use the App and the Services, so that Visa’s partners may be aware of frequency, numbers and activities of the Users on the App as well as understand how often people use the App and Services. However, for the avoidance of doubt Visa will not make specific identity references to any User in the provision of such aggregate information to its partners under this Clause 1.5.
1.6 Visa will neither rent nor sell User’s Personal Information to anyone. Visa may share User’s Personal Information only as described in this Privacy Policy.
1.7 Users may choose not to provide Visa Personal Information when Users use the Site or the Services. However if the information request is not identified as optional and Users choose to not provide required Personal Information, then Users may not be able to use features of the Site and the Services.
2. SHARING OF PERSONAL INFORMATION
2.1 If a User has linked his/her Social Network Account to the App (during the registration process or at any time thereafter), then the User’s “friends” on the linked accounts may see the location and time of User’s trips shared, list of Travel Experiences, “DID THIS” and other information such as offers saved. Individuals reading this information may use it or disclose it to other individuals or entities without Visa’s control and without User’s knowledge.
2.2 Once User has shared his/her travel experiences or entire trips on the App, User is aware that the following information will or may become public(as and when this function is used or available on the App):
- Trip Name
- Location and duration
- Total cost of the trip
- Price range
- Trip type
- Offers & ATMs saved
- Travel Badges
2.3 The App and Services also have, or may have in future, features that may allow a User to share his/her information with others. User understands that that if User chooses to provide personal information using such features of the App or Services, then User’s information shared may be available to the wider Visa community, or may be published on the Visa website, which is subject to indexing by third party search engines.
2.4 If User visits any third-party websites that are linked from the App, or uses any third-party applications linked to or connected to the App, User understands and acknowledges that certain Personal Information of User may be retrieved or tracked (by automated or other means) by third-party website owners or applications developers, over which Visa may have no control and Users should review such third party website’s or application’s privacy policy. Visa shall not be responsible in this regard, and makes no representation or guarantee that such third parties will protect the User’s Personal Information or follow Visa’s Privacy Policy.
2.5 If Visa or substantially all of its assets are acquired, or in the unlikely event that Visa goes out of business or enters bankruptcy, User understands and agrees that his/her Personal Information may be transferred to or acquired by the relevant third party acquirer or liquidator . Users also understand and agree that prior to the consummation of any such transactions, their Personal Information may also be shared by Visa for purposes of facilitating such transactions.
2.6 Visa may disclose Personal Information of any User, including where necessary with other companies and organizations outside of the User’s country of residence, when Visa in good faith believes that such release is necessary to:
- comply with the law, including laws outside the User’s country of residence;
- enforce or apply the Terms of Use and any other agreements to which Visa or the User is subject;
- protect the rights, property, or safety of Visa, our employees, other Users, or others; and
- investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of the terms and conditions of using the App.
3. COOKIES
3.1 The App may use cookie technology to improve user experience on the App and gather data for web site or mobile statistical reporting. Cookie technology does not capture individual email address or any Personal Information.
3.2 A cookie is a small piece of information sent by a web site or mobile app that is saved on a user’s hard disk by the user’s computer’s browser or on a user’s mobile phone. It holds information a site or an app may need to personalize a user’s experience and gathers web site or mobile statistical data, such as which pages are visited, what is downloaded, the Internet provider’s domain name and country that visitors come from and the addresses of sites visited immediately before and after coming to the website or mobile app. However, none of this is associated with a User as an individual and is measured only in aggregate.
3.3 To browse without cookies, a User can configure his/her browser or mobile phone to reject all cookies or to notify User when a cookie is set. (Each browser is different, so User should check the “Help” menu of his/her browser or mobile phone to learn how to change User’s cookie preferences.) A User’s experience of the website or App may be different if User sets his/her browser or mobile phone to block cookies.
4. SECURITY OF PERSONAL INFORMATION
4.1 Each User’s Personal Information is protected by a password for privacy and security. It is User’s responsibility to prevent unauthorized access to User’s account and Personal Information by selecting and protecting his/her User password appropriately, and limiting access to User’s computer and browser by signing off after User has finished accessing his/her account.
4.2 Visa uses security technologies including firewalls and secure socket layers to help protect the Personal Information Visa collects from Users. Visa's policies restrict access to Personal Information to those employees and service providers who need to know the information in order to provide Users with the Services. Visa uses its best endeavours to maintain physical, electronic and procedural safeguards to protect Personal Information.
4.3 While Visa endeavours to safeguard each User’s Personal Information to ensure that each User’s account information is kept private, as described in Clause 4.2 above, Visa cannot guarantee the security of User’s account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of User information at any time and User understands, acknowledges and assumes this risk.
5. INTERNATIONAL USERS
Users located outside of Singapore should note that the App’s database is hosted on computer servers in Singapore. Accordingly, Users’ information may be processed and stored in Singapore. As a result, the Singapore government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of Users’ information through laws applicable in Singapore. User’s use of the App or the submission of any Personal Information to or via the App will constitute User’s consent to the transfer of his/her Personal Information outside of User’s home country, including Singapore, which may provide for different data protection rules than in User’s home country.
As User’s information will be processed and stored in Singapore, Visa personnel, its related companies and companies controlled by Visa Inc. (“Visa Related Companies”), Visa’s partners and/or Visa Vendors located outside of Singapore who need to access and/or use Users’ information in accordance with this Privacy Policy will or may access Users’ information remotely from their respective countries.
6. USER ACCESS OF OWN PERSONAL INFORMATION
Visa allows each User to access the following information previously submitted or recorded on the App about himself/herself for the purpose of viewing, and in certain situations, updating that information and ensuring that it is accurate and complete:
- Name
- Countries
- Cities
- Mobile phone numbers
- Email addresses
- Password
- Visa card types
- Interest Categories
- Communication preferred
- Linked Social Network Account
User can access the above information about himself/herself on the App by visiting the User Profile page. Users may contact Visa at the email address at the bottom of this policy to request access to or that we update, or correct the Personal Information. Visa is not responsible for permitting Users to access or edit Personal Information that the User provides to a third party, including any app, social media platform, or wireless service provider.
7. DELETION OF ACCOUNT/ INFORMATION BY USER
7.1 Should a User decide to delete his/her user account from the App or the Site, User may do so by clicking on the "delete account" link on “Edit Profile Page” after logging into the Site. User understands that by deleting his/her account, his/her account details including profile, travel history (including DID THIS), travel badges received, User Submissions (as defined in the Terms of Use) and any promotional offers received by User, will be no longer retrievable/accessible or editable by the User. Visa will take all practicable steps to delete the Personal Information which it no longer requires for the purposes outlined in Clauses 1.2 and 1.3 above. However, all information and activity previously posted or embedded onto the App by the User prior to the deletion of his/her account (such as but not limited to “DID THIS” posted by the User, and all trips or experiences submitted by the User) may remain and may show up in any search performed on the App (but will not be linked to a user name). Accordingly, Visa makes no representation or warranty that content or actions previously posted or embedded onto the App by the User will be removed by an account deletion. User acknowledges and understands the rights which Visa retains in respect of such contents, as such rights are specified in the Terms of Use.
7.2 Even after User has removed information from his/her account or profile, copies of that information may remain viewable elsewhere, to the extent it has been shared with others, it was otherwise distributed pursuant to User’s privacy settings, or it was copied or stored by other users.
8. INACTIVE ACCOUNT ON THE SITE
Inactive users who have not signed in to the Site with their User ID for a substantial period of time (for example, 2 years or such other period as may be determined by Visa in its discretion) may be prompted by Visa (via email reminder to the registered email account) to log in to the Site. Further email reminders will be sent in the event that the User remains inactive, with intervals of approximately 30 days. Visa reserves the right to delete the User’s account (without further reference or notice to the User) after 3 email reminders have been sent and User remains inactive for 30 days after the last email reminder, and the consequences of such deletion will be similar to an own deletion by User under clause 7 above.
9. CHANGES TO PRIVACY POLICY
Visa may amend this Privacy Policy from time to time in its sole and absolute discretion. The terms governing use, collection and storage of Personal Information will be the terms prevailing at the time when such Personal Information is submitted or provided in any other way to Visa by the User. If Visa makes material changes in the Privacy Policy, Users registered at the time of such changes will be notified by Visa posting an announcement on our App or sending such Users an email. Users are bound by any changes to the Privacy Policy when they use the App or any of the Services after such changes have been first notified.
